Give Us What We Want Or Else :- Australian Matthew Ng jailed in China for embezzlement

An Australian businessman has been sentenced in China to 13 years in jail for embezzlement.

Matthew Ng, a Chinese-born Australian citizen, was detained by police in the city of Guangzhou in November 2010.

His trial centred on a commercial dispute between his travel company Et-China and Lingnan Group, a corporation owned by the Guangzhou municipal government.

The Australian government has raised concerns with Beijing over the case.

"We have made clear to Chinese authorities our strong interest in Mr Ng's case," said the Department of Foreign Affairs in a statement.

The department said Prime Minister Julia Gillard had talked to Chinese Premier Wen Jiabao about Ng's case, and other officials had spoken to the Guangdong government.

But Australian officials said they could not detail their concerns because Ng was expected to appeal against the sentence.

Ng was convicted of four offences related to bribery and corruption at the Intermediate People's Court of Guangzhou.
'Sacrificial object'

His company took a majority holding in a firm called GZL, a subsidiary of the Lingnan Group, during 2007 and 2008.

But Lingnan later asked Ng to sell the shares back at the original price, Australian media reports say.

Ng refused, and Australian commentators say he was punished for refusing to bow to the state-run firm.

He reportedly told the court at his sentencing that he was a "sacrificial object" in a bigger game.

But Chinese prosecutors accused him of illegally transferring money between Et-China and GZL, and bribing GZL officials.

Chen Yong, one of Ng's defence lawyers, told the BBC that prosecutors had submitted new evidence to the court.

"After cross-examination, the court suddenly announced that they were going to deliver the verdict," he said. "We were all surprised by that."

Nikki Chow, Ng's wife, told Australian media she was devastated by the sentence.

"Thirteen years for Matthew, I don't think he can take it," the Sydney Morning Herald quoted Ms Chow as saying.

"He was shocked, very shocked, nobody expected the verdict would be today."

A Chinese foreign ministry spokesman said that "competent authorities tried the case in accordance with the law".

The court also jailed GZL boss Zheng Hong for 16 years for taking bribes, and GZL's former chief financial officer Kitty Yang Xiaoping for three-and-a-half years for charges including embezzlement.

Legal issues spook China investors

As one of only 18 non-mainlanders licensed to practise law in the People's Republic of China, Taiwanese lawyer Steve Chu has the audience in Kuala Lumpur eating out of his hand.

Having qualified at the New York and California bars, Mr Chu is offering his take on participating in the 21st century's answer to a gold rush.

What he presents is a litany of caveats and pitfalls, an hour long warning of the problems of doing business in China.

A crucial difficulty that often arises is linked to contracts.

Many mainland Chinese are finding it hard to grasp the importance of contracts, despite them being deemed essential by foreign investors, Mr Chu believes.

In addition, there are systemic difficulties.

"No one knows how many laws there are in China," he says, observing that central and regional governments often pass bills that completely contradict one another.

"A municipal or local congress is supposed to inform the central government within five days of passing a law.

"But there's no penalty for not doing so and many choose not to."

Discreet lobbying

Usually, a country's legal system offers business people guarantees of recourse in the event of a dispute.

Trust is key to get anything done in China

But China's contemporary body of laws only date back to 1979, and like the country itself the legal system is fast evolving.

Unlike in the West, where discussion papers presage legislation, in China laws are tried out and then pulled back in for an overhaul.

The situation is fluid to say the least, and potentially risky, Mr Chu insists.

Major business disputes in China tend to be closely watched by foreign embassies, which often engage in strong but discrete lobbying when things go wrong.

"Any government should treat business with or investment in China as a national security issue," he opines, insisting that "it's irresponsible to let businessmen find their own way".

Lack of trust

Scare stories abound.

Mr Chu believes many have fatally misread the mainland Chinese character, which he argues has been shaped by history.

A man hauls a tricycle load of beer past a billboard promoting a commercial complex in Beijing's central business district
Both Chinese attitudes and commercial law have evolved

The Singaporeans famously got burned in the early 1990s with the building of a business park outside Shanghai. The park flopped when a local competitor build one even closer to the city.

A decade earlier, Taiwanese and Hong Kong businessmen steamed in, thinking that as 'Chinese' themselves they'd have no problem setting up there.

What overseas Chinese find particularly hard to understand is the full impact of the Cultural Revolution, with its wholesale betrayal of people by their friends, neighbours and family during the ideological witch hunt of the mid sixties.

"That's the deepest scar people have in China today," Mr Chu says.

Ingrained distrust makes building a relationship with Chinese businessmen tricky.

And yet, once trust has been built, guanxi - or relationship - becomes as much the key to business in China as contracts are not.

A mainland businessman may treat the terms of a contract, already signed, as advisory, not absolute.

Guanxi on the other hand, with its 'I know you, you know me, we have history', and the face that can be lost from abusing that relationship, is the key foundation for business.

Francis Yeoh, chairman of he Malaysian company YTL, which owns Wessex Water and other utilities in Britain and Australia, smiles knowingly when asked about China, before reciting a telling tale.

"[Malaysian sugar baron] Robert Kuok went into China and built hotel, but Robert was prepared to take a risk and build a hotel on a 10 or 14 year lease," he says.

"You can't make your money back in that time, but he was prepared to bet that he could win an extension when his lease ran out."

"Guanxi, not contracts, is what it's all about."

Cheap quality

Others in Malaysia are fervent cheerleaders for China.

Tan Kai Hee, advisor to the Associated Chinese Chambers of Commerce and Industry Malaysia, is adamant.

"China is very safe," he says.

"As Malaysian Chinese, we know how to speak the language and we share the culture."

Mr Tan's company Hai-O Enterprse imports beer, medicated wine and health products from China.

"Chinese products are very good in quality, very cheap in price," he says.

Moreover, improving the rule of law in commercial disputes cases has been a priority in China, and this has had an impact, China watchers say.

Some even insist that the country's one party rule is the biggest obstacle to the strict enforcement of the rule of law and the central decision making on sensitive issues.

FKLI:- Are The Yankees Heading To The Rescue To Save Euroland Ass ?-  12/5/2011

One of the "problems" when trading in a low ADX environment is we must be ever ready to change direction. Such is what happened last week when market jumped back above lower Bollinger Band when I cut off all the shorts position. And I turned long when this price action is confirmed by a positive Stochastic. As long as the ADX is low (ie. below 20's), I will continue to trade with the Stochastic over the MACD.

Now that price has gone above the upper band and the MACD has also turned positive, I will have to conclude the bull is having an advantage over the bears, at least for the time being. Place stop at 1480. I take note the ADX has started rising, if it is able to go above the 20's and current price has stayed above its recent resistance level, there is a possibility that the bull may be back in a firmer control. As there is no special bullish formation in the chart, so I will treat this as a minor bullish cycle.

The weekly chart turns more bullish biased as the Stochastic continues its upward move while the MACD has resumed its upward move again (last week it dipped its head as if it is going to cross down). The DMI is still negative but the space between the D- and D+ is narrowing which is telling us the bears are losing ground. The ADX has finally dropped hinting a new move may be on the way. I find the most bullish item is the big white price candlestick which now closed above its recent resistance and middle band which is the 20 periods moving average. Many technical traders and some fundamental analysts watch the 20 SMA as a major threshold to identify bulls and bears. The next level is watched is of course the upper band, if price can close above 1512, then the bull can officially declare they have fought off the bears.

Is the big picture changing for the better? I think nobody, including those so called "experts"  honestly know for sure. But there is something interesting happening now that you may want to keep an eye on. And that is there is some subtle hint that America may be heading to bail out the Euroland.

And here's the New York Times :

WASHINGTON — European leaders are looking outside the continent for help solving the longstanding crisis over the euro, but while the International Monetary Fund may be able to help, it will not be the magic wand they seek.

The fund may be asked to assist further as leaders of the 17 European Union nations that use the euro meet to prepare for a summit meeting on Thursday and Friday. Chancellor Angela Merkel of Germany and President Nicolas Sarkozy of France are scheduled to hold talks in Paris on Monday, and,
at the request of President Obama, Treasury Secretary Timothy F. Geithner is meeting with European leaders next week.

Since 17% of the IMF fund comes from US, when if Obama agrees to it, the bailout plan will become a reality because the money is going to be real cash. And if with America's direct intervention, maybe the market will believe Euroland may yet  be saved and attackers will finally back off. This will buy more time for those Euro socialists to clean up their act. The whole thing begins to look like a poker game, it is always about who blinks first.

Other than applying technical analysis to read the market, I often find an understanding of the real political workings would also help a great deal to foretell what would likely to happen. Real politics mean not those biased reports by  the other Chinese papers which always tend to underscore/badmouth everything America does and hype hysterically on anything coming out from China. Like it or not, as far as the financial market is concerned, whatever America does will affect others one way or another. So it always pays if you can read their move unbiasedly.
KCPO:- At Crucial Support Level / Another Make Or Break Moment - 12/5/2011

The market continues to deteriorate but seems to find some support at the lower Bollinger Band which is also a 50% retracement point from its last up move. This 50% rule is making this support significant.  But as the Stochastic and MACD continue to fall and DMI stays negative, if the band support fails to hold, the next drop would be dramatic.

The weekly chart's Stochastic and MACD remain positive while the DMI is negative. ADX is still falling while prices stay below the upper band. But I would pay attention to the middle band support. When if price is to close below that level, maybe a stronger bear move would start from there. For now all I can say about the chart is it is in a no man land. Lets wait for another week or two in order to have a clearer reading of its next possible direction.

Many of the funds managers seem to be waiting for a clearer lead from a near term outcome of the Euroland financial crisis to decide their next course of action. Hence most of the commodities market has not shown any clear direction yet.

And we have the Shit paper Group and  "community leaders" who insist of making huge donation everytime China has a natural disaster. Could this "poor helping the rich" mentality in bedded in the Chinese DNA or are we been brainwashed ?

Thing That Every Taxpayer In The World Would Love To Do

LUCKNOW, India (AP) — Two farmers fed up with alleged bribery demands emptied three bags filled with slithering snakes in a busy tax office in northern India, an official said Wednesday.

The 40 or so snakes of different sizes and species — including at least four deadly cobras — sent clerks and villagers climbing atop tables and scurrying out the door to escape the office in Basti, about 186 miles (300 kilometers) southeast of Lucknow, said Uttar Pradesh state official Ramsukh Sharma.

"Snakes started climbing up the tables and chairs," he said. "There was total chaos. Hundreds of people gathered outside the room, some of them with sticks in their hands, shouting that the snakes should be killed."

No one was bitten or injured in the incident Tuesday afternoon, and police and forest officials captured the snakes.

The farmers had been asking for tax records for their land in nearby Narharpur village, but tax officials withheld the files for weeks while allegedly demanding bribes.

Sharma said their method of protest was unacceptable. Police are searching for the farmers, who were identified as Hukkul Khan and Ramkul Ram. Khan is known locally as a snake charmer.

BRICs =
Bloody Ridiculous Investment Concepts

The term "BRIC"—coined by Goldman's Jim O'Neill 10 years ago to denote Brazil, Russia, India, and China—should really denote "Bloody ridiculous investment concept," writes Societe Generale strategist Albert Edwards in a note out this morning.

That's because the BRICs—as well as emerging markets in general—are actually doing terrible right now; even worse than the struggling eurozone.

He writes that the only reason investors are continually pumping money into BRIC countries is a deluded fantasy that investment returns are tantamount to growth. But this dream won't come true when they're paying out the nose to invest:

It is no different from many of the other investment fantasies I have witnessed over the last 25 years only to see them end in severe disappointment. If growth does matter to investors, they should be worried that things seem to be slowing sharply in the BRIC universe, most especially in Brazil and India...The crucial driver investors are missing is the change in global liquidity as measured by growth in EM foreign exchange reserves. Confidence often ebbs as growth slows and EM economies are seeing a sharp drop in reserves and liquidity tightening.

He says that this graph comparing BRIC equity markets to markets in the eurozone and around the world just proves his point:
